REGULAR MEETING
NOVEMBER 8, 2007

Pursuant to notice published in the Garden County News, the Oshkosh City Council met for regular meeting convening on November 8, 2007, at 7:30 p.m.

Mayor Gette announced the open meetings law is posted on the west wall of the Council Chambers and available for public inspection.

Present were the Mayor Larry Gette, City Council Members: Brian Moffat, Carol Lake, Jim Levick, and Roger Gray. Also attending: City Administrator, Bill Campbell, Attorney, J. Leef, and City Clerk, LeAnn Brown.

Motion by Gray, seconded by Moffat, to approve the agenda and minutes of the previous meeting and waive the reading of the same. Motion carried unanimously.

Motion by Moffat, seconded by Levick, to approve the following bills. Motion carried unanimously.

Attorney Leef updated the Mayor and Council concerning the current Health Board's findings and what the next steps the Health Board need to take. She also explained the condemnation process.

Motion made by Levick, seconded by Lake, to approve Resolution No. 07-07. Motion carried unanimously.

RESOLUTION NO. 07-07

RESOLUTION AUTHORIZING ASSESSMENT AGAINST THE PROPERTY LAND OWNERS FOR REMOVING WEEDS AND GRASS MOWING.

WHEREAS, the City of Oshkosh, pursuant to Section 6-314 of Ordinance No. 274, City Code requires that vegetation be mowed or removed so that it extends no more than six inches above the ground and;

WHEREAS, the City, after notice proceeded to mow certain properties within the City limits to comply with City Code.

NOW THEREFORE, BE IT RESOLVED, by the City of Oshkosh that the following property owners of the following Real Estate be assessed the following amounts and that the assessment be levied against the property and that the Garden County Treasurer be authorized to assess the tax against the property.

Motion by Moffat, seconded by Gray, to approve Resolution No. 08-07. Motion carried unanimously.

RESOLUTION NO. 08-07

WHEREAS, the City of Oshkosh, Nebraska recognizes that a properly functioning public water supply is necessary to the health and welfare of the citizens of Oshkosh; and

WHEREAS, the Mayor and City Council have determined that portions of the City public water supply system are in need of significant repair and improvement; and

WHEREAS, funding for the cost of the Preliminary Engineering Report and/or other eligible planning grant activities of the City public water supply system may be obtained by grant from Nebraska Department of Environmental Quality, subject to certain requirements and obligations;

NOW, THEREFORE BE IT RESOLVED by the Mayor and City Council of the City of Oshkosh, Nebraska that they should make application for grant between the Nebraska Department of Environmental Quality through the Nebraska Environmental Partnerships; and

BE IT FURTHER RESOLVED, Lawrence D. Gette, Mayor, is hereby directed to execute the application and all other documents necessary to facilitate the grant between the Nebraska Department of Environmental Quality to the City of Oshkosh, Nebraska for the purpose of planning for the repairing and improving the City water supply system; and

BE IT FURTHER RESOLVED That LeAnn Brown, City Clerk be authorized and directed to sign the payment or outlay request forms, sign all necessary documents to furnish such assurances to the State of Nebraska as may be required by law or regulations and to receive payment on behalf of the applicant.

Mayor Gette signed the Warranty Deed for the transfer of the Fire Hall building and land to Garden Co. Rural Fire Dist. #2.

The Mayor and Council discussed several options from Plummer Ins. Co. No action was taken.

As requested by a patron, the Mayor and Council discussed removing the assessment against property for the mowing at Tax Lot, Avenue C. With Attorney Leef's advisement the Council stated that when patron has a signed purchase agreement or copy of a quit claim deed they would consider such request again.

Motion by Gray, seconded by Levick, to approve Mayor Gette's re-appointment of Deanne Cooper and Jim McKeeman to the Planning Commission for a three year term. Motion carried unanimously.

Motion by Lake, seconded by Moffat, to approve Ordinance No. 393. Motion carried unanimously.

ORDINANCE NO. 393

AN ORDINANCE TO AMEND SECTION 2-204 OF THE CITY OF OSHKOSH MUNICIPAL CODE AND TO REPEAL ANY SECTION IN CONFLICT THEREWITH.

Be it ordained by the Mayor and Council of the City of Oshkosh, Nebraska:

Section 1. That Section 2-204 of the Municipal Code of Oshkosh, Nebraska is hereby amended to read as follows:

2-204 Board of Health.

The Governing Body shall appoint a Board of Health which shall consist of four (4) members. The members of the Board shall include the Mayor, who shall serve as chairman; the City Marshall, who shall serve as secretary and quarantine officer; a physician or physician's assistant or nurse practitioner, as determined by the mayor, who shall serve as the medical advisor; and the President of the City Council. The members of the Board shall serve, without compensation, a one (1) year term of office, unless reappointed, and shall reorganize at the first (1st) meeting in June or each year. It shall be the duty of the secretary to keep the full and correct minutes and records of all meetings and to file the same with the Municipal Clerks where they shall be available for public inspection at any reasonable time. The Board of Health shall be funded by the Governing Body from time to time out of the General Fund. A majority of the Board shall constitute a quorum of the purpose of doing business. The Board shall meet at such times as the Governing Body may designate. Special meetings may be members of the Board. It shall be the duty of the Board to enact rules and regulations which shall have the full force and effect of law, to safeguard the health of the residents of the Municipality. Included in the duties of the Board shall be to enforce the said rules and regulations, and to provide fines and punishments for any violations thereof. It may regulate, suppress, and prevent the occurrence of nuisances and shall actively enforce all laws of the State of Nebraska and ordinances of the Municipality relating to matters of sanitation which affect the health and safety of the people. The Board shall regularly inspect such premises and businesses as the Governing Body may direct. All members of the Board shall be responsible for making such reports and performing such other duties as the Governing Body may, from time to time, designate. No member of the Board of Health shall hold more than one (1) Board of Health position. (Ref. 17-121 RS Neb.)
