MINUTES
MAY 10, 2007

Pursuant to notice published in the Garden County News, the Oshkosh City Council met for regular meeting convening on May 10, 2007, at 7:30 p.m.

Mayor Talley announced the open meetings law is posted on the west wall of the Council Chambers and available for public inspection.

Present were the Mayor Cindee Talley, City Council Members: Brian Moffat, Larry Gette, Carol Lake, and Jim Levick. Also attending: City Administrator, Bill Campbell, City Attorney, J. Leef, and City Clerk, LeAnn Brown. Absent: None.

Motion by Lake, seconded by Gette, to approve the agenda and minutes of the previous meetings and waive the reading of the same. Motion carried unanimously.

Motion by Moffat, seconded by Lake, to approve the following bills. Councilman Levick abstained from warrant #23781. Motion carried unanimously.

OLD BUSINESS:

Attorney Leef reported that the next step is to have the Sheriff Singpiel post letters on properties that still have a junk car or have not complied with the Health Board requirements.

A Health Board meeting is set for Saturday, May 12th, to re-visit the properties for one more check before the letters are posted.

NEW BUSINESS:

Sheriff Singpiel gave his report. For the month of April, there were 200 hours spent in Oshkosh.

Motion by Levick, seconded by Moffat, to approve Resolution No. 04-07. Motion carried unanimously.

Resolution No. 04-07

WHEREAS, the Mayor and City Council of the City of Oshkosh has decided to sell city owned property at a consignment auction; and

WHEREAS, the date of the consignment auction will be June 16, 2007, at 10:00 a.m. at the Oshkosh City Auditorium, by Smokey's Auction Service as the auctioneer; and

WHEREAS, Smokey's Auction Service desires to donate their time and auction service for the consignment auction; and

WHEREAS, any charges relating from the consignment auction occurred by Smokey's Auction Service will be paid by the Auditorium Renovations Committee, Foundation Fund; and

WHEREAS, that the highest bidder will be responsible for removing the auctioned item(s) from the City Auditorium on the 16th day of June, 2007; and

THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF OSHKOSH, NEBRASKA, that the highest bid will be accepted for the sale of city owned property at the consignment auction. Said notice of the auction of city owned property will be published in Garden County News prior to said auction.

The Mayor declared Resolution No. 04-07 duly passed and approved.

Bids from KN Inc., and Moe's Heating & Air Conditioning for new heaters at the Auditorium were opened and discussed. Motion by Levick, seconded by Gette, to accept the bid from Moe's Heating & Air Conditioning. Voting Yea: Levick, Gette, Lake. Moffat abstained. Motion carried.

The Mayor and Council added some rules to the Auditorium Rental Agreement. The rules are: Absolutely No Holes in Walls, Wipe off all Tables & Chairs used During Function, and use the Special Cleaner to Clean Wood Floor.

Motion by Moffat, seconded by Gette, to grant an Animal Permit, contingent with the neighbors approval, to Shirley Wiechel for chickens and rabbits for a 4-H project. Voting Yea: Moffat, Gette, Levick. Lake abstained. Motion carried.

Motion by Lake, seconded by Levick, to deny the Garden Club's request to use the Auditorium for free. Motion carried unanimously.

Motion by Lake, seconded by Moffat, to approve buiding permits to: Larry Schwartzkopf-Garage, Scott Smith-Addition, Jeff Wilhelm-Addition, and E & S Auto Supply-Shed. Motion carried unanimously.

Motion by Moffat, seconded by Lake, to allow the change of lot lines to run from north and south to east and west for Tax Lot 17 (Partial) on behalf of Travis Sullivan, and request a certified copy of the platted changes. Motion carried unanimously.

Administrator Campbell gave his report and Mayor Talley followed with her report.

A special meeting will be held at the Oshkosh Fire Hall, May 31st at 7:30 p.m., with the Oshkosh Fire Department and the Rural Fire Department, to discuss combining both departments.

Motion by Lake, seconded by Moffat, to adjourn the meeting at 8:40 p.m. Motion carried unanimously.
